Culinow respects copyright. This page sets out how to report material on Culinow that you believe infringes your copyright, how to respond if your material was removed by mistake, and what happens to accounts that infringe repeatedly. It supplements section 23 of our Terms of Service.
1. Designated Copyright Agent
Culinow has designated an agent to receive notifications of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. §512(c)(2). The designation is on file with the United States Copyright Office and is listed in its public Designated Agent Directory.

Notices sent to any other address may not reach the designated agent and may not be effective. Please use the details above.
2. Reporting Copyright Infringement
To report material you believe infringes your copyright, send a written notice to the designated agent above. Under 17 U.S.C. §512(c)(3), the notice must include:
- A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed. If several works are covered by one notice, a representative list of them.
- Identification of the material claimed to be infringing, with enough detail for us to locate it — a direct URL is best.
- Your contact details: address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.
A notice that is missing these elements may not be effective. Please also note that under 17 U.S.C. §512(f), a person who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and legal fees.
On receiving a valid notice we will act expeditiously to remove or disable access to the material, and will take reasonable steps to notify the person who posted it.
3. Counter-Notification (Counter-Notice)
A counter-notification, also called a counter-notice, is how you ask for material to be put back. If your material was removed or disabled and you believe that was a mistake, or that you have the right to use it, you may send a counter-notification to the designated agent above. Under 17 U.S.C. §512(g)(3), it must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and the location at which it appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside the United States, to the jurisdiction of any judicial district in which Culinow may be found — and that you will accept service of process from the person who filed the original notice, or from their agent.
We will forward a valid counter-notification to the person who filed the original notice. Unless they notify us within 10 business days that they have filed a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days after receiving the counter-notification.
§512(f) applies to counter-notifications as well: a knowing material misrepresentation that material was removed by mistake can carry liability for damages.
4. Repeat Infringer Policy
Culinow has adopted, and reasonably implements, a policy of terminating the accounts of users who are repeat infringers, as required by 17 U.S.C. §512(i).
A copyright complaint that results in the removal of material is recorded against the account that posted it. In deciding what to do we consider how many complaints an account has received, whether any counter-notification was made, whether the same work is involved, and the seriousness of the infringement. In practice:
- A first valid complaint results in removal of the material and a warning to the account holder.
- Repeated valid complaints result in suspension, and then in termination of the account.
- Clear, wilful or large-scale infringement may result in immediate termination without a prior warning.
A complaint that is withdrawn, or that is answered by a counter-notification we act on, is not counted against the account.
